All information and rules in these terms and conditions refer to the website FoodPort.ch as well as to other websites, which refer to FoodPort.ch. FoodPort LLC is managed by the legal or natural people listed in the imprint. Special regulations of legal subjects in the partnerships with various retailers remain expressly reserved. We would like to point out that we reserve the right to change information, as well as the rules on the use of our service at any time. These changes are binding.
Subject to other regulations, the operator, FoodPort, is the owner of the platform. However, all companies, brands, names, names, logos, partial images, designs, texts and other materials used on the platform do not belong to the platform operator, but to the listed partners. In the case of delivery, PET bottles are not taken back. Glass bottles with and without depot, preserves in cans and glass as well as packaging cartons must be disposed of by the customer himself/herself.

The operator excludes all liability for the transmission of data of any kind through the Internet. Even though Switzerland enjoys the reputation of a high level of data protection, there is no proof of 100% safe data traffic. FoodPort, however, guarantees the encryption of all data packets. The operator points out that data can also be transferred abroad.

On the homepage of Foodport, customers can subscribe to the newsletter. The subscription can be terminated at any time and is not subject to any obligations.

The operator points out that he/she is only able to evaluate data for statistical purposes without the permission of the customer, but does not pass it on to third parties. However, exceptions are made when exceptional situations occur; Example: in the case of interventions by law enforcement authorities which have more rights and power than the operator. The storage of the data of all customers occurs because all access data, such as the date, time, IP address, et cetera, are stored when accessing the platform. Without the consent of the customer, which is to be regulated only by a separate declaration, all data will be treated confidentially. Otherwise, all data in the company remain with FoodPort.

Third-party services, especially Instagram, Google Analytics and Facebook- Like, are available on the operator’s platform. The operator points out that these services can often store files, mostly in the form of cookies, on the customer’s computer in order to analyze the surfing behavior. Among other things, the IP address is also recorded and stored. The operators can use these services to evaluate their own website and to create statistics. With these, the operator of the platform can then interfere and manage interests-related advertising. Please note that this information can also be transferred to other third parties at home and abroad. Above all, there is no adequate legal data protection abroad. The processing of this data processing can be prevented only with very great effort and is the responsibility of the operator of the platform. The operator shall endeavor to secure the storage of personal data. However, the operator is not liable for hacking and other illegal illegal digital attacks.

No products on the platform are the property of the online shop operator. FoodPort acts as an intermediary only. For this reason the operator does not insure the quality of the food. In case of questions, suggestions or other wishes the operator is available to every customer. In order to obtain specific answers to the product content, Foodport recommends direct contact with the manufacturer or supplier. The operator also points out that products may not look exactly as in the picture.

Alcohol-containing products are not sold to minors. The field to be used for the registration is decisive, which confirms that customers are of age. All data on the platform is binding.

If, due to his/her private situation, the customer is not prepared to accept the ordered goods as agreed, the courier will leave the goods in front of the flat/house. The operator and his suppliers assume no liability for the condition of the food if the customer cannot receive his food in time. Using GPS data and photos, FoodPort can indicate exactly which location, which parcel has been deposited with the customer. As soon as the goods have been stored at the customer’s door, the delivery partner no longer assumes any liability.
If the supplier is not able to deliver the goods within a period of 2-3 working days for various reasons, there is no claim for damages. The quantity actually delivered is indicated on the final delivery note and on the invoice. The operator/supplier does not offer any forwarding.
Orders already confirmed cannot be changed or cancelled due to the administrative work involved. The operator and its dealers will endeavour to adapt this in the foreseeable future and to the benefit of the customer.
Drinks / food as well as medical equipment are excluded from the right of return for hygienic reasons and safety considerations. The same applies to food supplements and other remedies.
In any case, they are entitled to a right of return if there is a material error (OR24) or deception (OR 28) in accordance with the Swiss Code of Obligations.

By returning shipment, the customer thus claims a service from the supplier selected in each case. The customer is therefore obliged to pay the full amount. Our vendors run a grocery store which contains highly frequented groceries. This means that fresh food is always on the shelves. After an online order has been placed, a look is taken at the expiration date to ensure that nothing expires within a (canned food).

Products and labels change after certain time. Our product pictures were all created in a longer procedure and were very time-consuming. Therefore, they are rarely replaced by newer ones.

In case of visible damage, we ask you to refuse acceptance. If you did not recognize the damage immediately, please contact us at info@foodport.ch.
Please send us appropriate pictures of the damage.
We will refund you the money for the damaged goods and take care of the case of damage with the supplier.
By default, you will be contacted via e-mail. Please also check your junk folder. We also take the liberty of informing you by SMS as soon as your parcel is ready. However, the SMS is triggered manually and is therefore much slower than our e-mail system.
Deliveries over 31.5kg are not delivered in one piece due to our DHL conditions. If, for example, you order 80kg, 3 packages will be packed and delivered one after the other on the following days.

Refrigerated goods include all products that must guarantee compliance with the cold chain for delivery. These products are subdivided into two categories according to the effort involved in the web shop:

  • Fresh products
  • Frozen products

A delivery surcharge will be added to these product categories. This will be displayed in the delivery note.

With our cold goods dispatch we keep the uninterrupted cold chain according to the regulations. In order for us to be able to guarantee this, dispatch must be carried out quickly. The refrigerated goods are only handed over to the supplier from Monday to Thursday, so that they can arrive during the working days. Your parcel will also be left unasked in front of your front door if you are not at home. The liability passes to the buyer from the time of delivery. We use cooling pads and drinking water bottles for cooling. The drinking water bottles are brand-new, free of charge and can be consumed.
